Green Card marriages are more common than people think. When someone is married to a U.S. citizen, whether the non U.S. citizen resides in the United States or not, they are eligible to apply for legal permanent U.S. residence or citizenship. However, several requirements must be met as illegal Green Card marriages are at an all time high. When dealing with migratory issues, due to the legality of the matter, it is always highly advisable to seek advice and perhaps even hire an immigration attorney. The fact is that a U.S. citizen can actually request a Green Card for their fianc or fiance. However, a permanent resident cannot and must either wait to marry their partner, or obtain their own citizenship in order to help them with their Green Card. A Green Card marriage is not advisable if it is done for the sole purpose of obtaining a Green Card. This is not only illegal put punishable by law with very expensive fines and or even jail sentence. A person that is applying for a Green Card via their marriage to a U.S. Citizen, better be prepared to meet all the requirements necessary and go through an extensive interview, which is performed by an immigration officer, who may chose to be or not be very friendly. When attending a Green Card marriage interview, both spouses should take a matching set of house keys and be ready to answer many question. These will vary from life as a married couple, to personal individual questions, to family and things from the past. If fraud is suspected or detected during a Green Card marriage interview, the couple will have to meet with the fraud department, where each will be extensively interviewed in separate rooms. Be prepared to answer questions such as what things you and your spouse have in common, and if any tattoos or body marks and where? Who sleeps on what side of the bed and who made that decision and why? The list goes on, from very simple questions, to very private and perhaps even embarrassing questions. Keeping your cool is key to a successful interview. When there is a suspicion of Green Card marriage fraud, couples may be pressured to a confession and or may be even given a document to sign, which declares that the marriage is a fraud. Legitimate married couples should never sign such documents or allow any type of pressure to intimidate them. If a document of this sort is asked to be signed, and your marriage is a legal bon-a-fide marriage, not a “Green Card Marriage,” you have the right to ask them to stop and re-schedule a meeting with them at another time with your attorney present!

Increasing the punishment for identity theft
What punishment should identity a theft criminal’s face? A good one may be for them to pay all the bills that they have passed over to their victims. There have been calls for the punishment of identity theft offenders to be increased in the country. Identity thieves now face multiple charges when they are arrested. In addition to stealing personal information, the offenders have a string of charges that may be tied to them. Some of them include email fraud, wire fraud, mail fraud, spamming and money laundering. Prosecutors across the States have also been agitating for an increase in the punishment of identity thieves. For example, in Oklahoma prosecutors have proposed the punishment to be revised to a minimum of 2 years up to a maximum of 10 years. The existing legislation provides for a fine of up to $100,000. The laws, which were signed in 2004, say that identity theft has been regarded as a serious crime and sentencing guidelines have been adopted to aid the prosecution of offenders. The Identity Theft Penalty Enhancement Act outlines different prison terms and compulsory penalties for thieves who have been convicted of different crimes, like terrorism and mail fraud. Some of the increased punishments that the law has brought into place include: The maximum penalty for identity theft under the Federal law has been increased from 3 to 5 years Anyone who carries out identity theft with the aim of undertaking terrorism will have his penalties increased by 5 years. Clarification of the maximum sentence of 25 years for persons who want to aid terrorism applies both to domestic and international terrorism. A person who has in his possession identity documents with the intention of carrying out criminal activities is also now targeted by this Law. The Law also directs the Sentencing Commission to overhaul its guidelines in order to be able to punish insider offences which involve “abuse of trust” of the person who has committed the crime. The department of Justice has also been allocated $2 million every year from 2005 to 2009 to be used in investigating and prosecuting identity theft cases and other related fraud cases. It is important that consumers know how to protect themselves from falling victim to identity fraud.
